Business and working visas in Nepal

Foreign investment and foreign employment involve different legal routes. A business visa supports qualifying investment or business activity; a working visa supports authorised employment. Neither should be selected only because it appears easier.

Quick answer

An investor generally coordinates foreign-investment and industry records, company documents, tax compliance and a Department of Industry or line-agency recommendation before the business-visa filing. A foreign employee generally needs an eligible Nepal employer, appointment or employment contract, labour permission and the required government recommendation before the Department of Immigration issues the working/non-tourist visa.

Business visa eligibility

The Department describes the business visa as available to investors and businesspersons investing or undertaking business in Nepal. Eligibility must be supported by the legally approved investment and the applicant's documented connection to it.

An employee, consultant or representative is not automatically an investor. Where a non-investor role involves work, the working route may be the correct analysis even if the employer has foreign investment.

Business visa document architecture

The current official list includes an online application, recommendation from the Department of Industry or relevant line agency, foreign-investment acceptance, company and industry registration, PAN or VAT record, passport and latest visa, and additional investment or share evidence where applicable. Renewal may require tax clearance, monitoring and progress material.

The precise list depends on the investment structure and current schedule. Check that: - the investor name and passport match the approval and share records; - the invested amount can be evidenced through lawful banking and company records; - company, industry and tax registrations remain current; - the applicant's position and requested duration are supportable; and - renewal reports reflect the company's actual operation.

Working/non-tourist visa eligibility

The working route applies to qualifying foreign nationals accepting employment in Nepal. The Department states that it is issued through the Non-Tourist Visa Section on recommendation from the relevant government line agency.

The employer must assess whether local recruitment, sector approval, professional qualification, security clearance or other preconditions apply. A senior title or payment outside Nepal does not remove Nepal work-authorisation requirements when the person works in Nepal.

Working visa document architecture

Depending on the role and sector, the file may include: 1. official online application; 2. recommendation from the competent ministry or line agency; 3. labour or work permit; 4. work agreement or approval where prescribed; 5. appointment letter and Nepal-law employment contract; 6. employer registration and tax-clearance records; 7. applicant qualification and experience evidence; 8. passport, current Nepal visa and photographs; and 9. Social Welfare Council documentation for relevant NGO or INGO work.

Names, job title, employer, workplace, salary, project and duration must agree across the labour, ministry and immigration records.

Business visa is not a work permit

Investment, directorship, management and employment can overlap, but they are not legally identical. Document every capacity. An investor's visa should not be used to conceal an unrelated job, and a work permit does not by itself replace the immigration visa.

Dependants

Spouses and children may have a route connected to the principal applicant depending on the category and current rules. Provide reliable relationship records, translations or authentication where required. A dependant should not work unless separately authorised.

Renewal and corporate compliance

Start renewal preparation before expiry. Business-visa renewal can be affected by tax clearance, investment evidence, company operation and industry monitoring. Working-visa renewal can be affected by the labour permit, employer compliance, contract, tax and recommendation validity.

Changes to employer, job, investment, passport, address or corporate status may require advance advice, notification, transfer, cancellation or a fresh application. Do not assume the old permission continues after a material change.

Practical timeline

The immigration filing is only the last part of a multi-authority process. Time is often spent correcting company records, obtaining industry or ministry recommendations, completing labour permission and reconciling tax documents. Government processing estimates should begin only after a complete eligible file reaches the correct authority.

Employer and investor checklist

1. Classify the activity as investment, work or both. 2. Map every required authority and approval in sequence. 3. Audit company, industry, tax, labour and passport records. 4. Use a Nepal-law contract matching the approved role. 5. File through the current official immigration portal. 6. Verify visa category, dates and re-entry conditions after issue. 7. Calendar passport, permit, recommendation and visa expiry separately. 8. Reassess before any material role or ownership change.
