Foreign-worker compliance for Nepal employers

Approval is the start of compliance, not the end. Employers should keep the foreign worker's job, contract, labour authorization, working visa, payroll, tax, workplace and actual duties aligned throughout the assignment.

Quick answer

Create one controlled file for every foreign worker, prohibit work before approval or after expiry, track the passport, labour permit, visa and recommendations separately, maintain recruitment and Nepali knowledge-transfer evidence, review every role or employer change in advance, and complete cancellation, final payroll, tax, visa and departure steps when employment ends.

Build a three-layer authorization map

For each worker, record: 1. labour authorization: approved employer, role, location, period and conditions; 2. line-agency or sector approval: recommendation, work agreement, professional licence or project authority; and 3. immigration status: visa category, passport, entries and valid-until date.

One valid layer does not repair an expired or incorrect layer. A work permit does not extend a visa, and a visa does not renew a work permit.

Pre-start control

HR should not rely on an offer letter or portal receipt. Before system access, payroll or productive duties begin, verify the issued labour authorization and correct working visa, passport validity and every required professional approval.

Define carefully what counts as work. Unpaid trial activity, consultancy, management, technical supervision or remote duties performed in Nepal can still require assessment.

Employment and payroll alignment

The signed contract, job description, approval and actual work must match. Keep lawful remuneration, benefits, leave, insurance or social-security treatment, tax withholding, attendance, expenses and payment records.

The Labour Act requires foreign-worker terms and facilities not to fall below applicable standards. The contract must be in English or a language the worker understands. Coordinate foreign-currency remittance with tax and banking evidence rather than promising unrestricted transfer.

Recruitment and knowledge transfer

Preserve the original vacancy and candidate assessment supporting the foreign hire. Maintain a realistic plan showing which Nepali employees receive training, the skill to be transferred, milestones, attendance and progress.

Avoid a generic replacement statement repeated at each renewal. Authorities may examine whether the employer acted consistently with the purpose of allowing scarce foreign expertise.

Ratio and headcount monitoring

Recalculate the applicable foreign-worker ceiling whenever headcount changes or another foreign worker is proposed. The general five-percent rule has treaty and specific-establishment provisions, so HR should document both the calculation and the legal basis for any exception.

Renewal calendar

Track at least: - passport expiry; - current visa expiry; - labour permit expiry; - work agreement and line-agency recommendation; - employment-contract end date; - professional licence; - company tax clearance and audit status; and - dependant status.

A 90-day review and 60-day document start are prudent internal controls for multi-authority cases, not official processing guarantees.

Renewal file

Confirm that the role still requires foreign expertise and that actual work matches approval. Update the contract, tax and payroll evidence, employer registrations, recommendation, passport and visa documents, training record, progress explanation and any recruitment material required by the current procedure.

Do not backdate a contract, advertisement or attendance record to hide a late start.

Employer, role and location changes

A permit is commonly connected to a specific employer and role. A transfer within a group, promotion, secondment, new project, changed location or substantially different duties can require fresh labour and immigration steps.

Obtain advice before the change. Depending on the facts, the old employer may need to cancel or close the approval and the new employer may need a fresh application and visa action.

Business and residential status

A foreign director or investor may have both corporate and employment capacities. Record board authority and investor activity separately from paid management or employment. Neither a business visa nor residential visa should automatically be used as a substitute for work authorization.

Dependants

Track the principal worker's status and each dependant separately. A spouse or child may require extension, transfer or departure coordination when the principal employment ends. Dependant status does not ordinarily authorise work.

End of employment

Create an exit plan covering: 1. lawful notice or termination and final working day; 2. handover, access and employer property; 3. final remuneration, benefits and tax settlement; 4. labour-permit and recommendation cancellation or closure; 5. visa cancellation, conversion, transfer or departure direction; 6. dependant status; 7. repatriation responsibility where applicable; and 8. retention of official receipts and exit evidence.

Do not leave a sponsored status active indefinitely after the legal basis ends.

Status gaps and unauthorised work

If a permit or visa expires, stop the affected work, preserve all records and obtain advice immediately. Do not attempt to solve the problem with false dates or an informal payment. Labour, immigration, tax and employer consequences may need coordinated resolution.

Quarterly audit checklist

- Every foreign worker appears on the approved register. - Actual employer, role, site and duties match approval. - Permit, visa, passport and recommendation remain valid. - Payroll, tax and attendance records reconcile. - Recruitment and training evidence is preserved. - Ratio calculations remain within the applicable rule. - Changes and renewals are calendared and assigned. - Departed workers and dependants have completed status steps.
