Sector licensing depends on every regulated activity a business performs. Build a matrix of authorities, prerequisites, technical and premises conditions, inspections, product rules, reporting and renewals before launch.

Sector-specific licences in Nepal

A business licence search should start with the regulated activity, not a generic form. The same company may need several approvals when it manufactures, imports, distributes, advertises, stores and sells one product through different channels.

Quick answer

Create a regulator matrix listing each activity, authority, legal basis, prerequisites, documents, technical personnel, premises, inspection, government fee, processing dependency, validity, reporting and renewal. Confirm which conditions must be satisfied before application, before inspection and before commercial launch.

Food and beverage

Food manufacturing, processing, packaging, storage, import, distribution and sale can trigger food-quality, hygiene, labelling, testing, local, industry and environmental requirements. Alcohol and other controlled products have additional licence and excise issues.

Map every product, ingredient, claim, package size, plant, warehouse and sales channel. Approval of one product or location should not be assumed to cover another.

Medicines, health products and facilities

Manufacture, import, wholesale, retail, advertising and professional handling of medicines are regulated activities. Pharmacies, hospitals, clinics, laboratories, medical devices, supplements and cosmetics may fall under different rules or classifications.

Confirm product status, responsible technical personnel, premises standards, storage, records, advertising and pharmacovigilance or reporting where applicable. Do not market a product as approved merely because a company exists.

Tourism and hospitality

Hotels, travel and trekking businesses, mountaineering services and other tourism activities may require tourism registration or classification alongside company, tax, local, premises, food, liquor, labour, fire and environmental compliance.

Business model matters: accommodation, booking intermediary, guide service and tour operation are not identical categories.

Banking, insurance, payment and financial services

Deposit-taking, lending, payment services, insurance and other regulated financial activities require approval from the competent financial regulator. Capital, ownership, fitness, governance, cybersecurity, AML/CFT, reporting and outsourcing rules may apply.

Avoid words or marketing that imply a regulated status before authorisation. A technology platform does not escape financial regulation merely by describing itself as software.

Telecommunications and digital services

Network operation, frequency use, telecommunications services, certain infrastructure and equipment can require Nepal Telecommunications Authority or other approvals. Digital businesses must also assess tax, consumer, electronic transactions, e-commerce, privacy, cybersecurity and payment rules.

The E-Commerce Act, 2081 now provides a specific statutory framework for electronic commerce. Its duties should be mapped with the underlying product or service regulation.

Education and training

Schools, colleges, foreign programmes, consultancies, training institutions and professional courses may require different education or local approvals. Curriculum, affiliation, facilities, teachers, advertising and student-fee practices can be regulated.

Construction, engineering and real estate

Contractor classification, professional licences, local building permission, land-use, environmental approval, project approvals and procurement registration may apply. A company objective mentioning construction is not a contractor licence.

Manufacturing and environment

An industrial project should be classified under the Industrial Enterprises Act and applicable schedules. Registration authority, environmental study, site, capacity, utilities, machinery import, standards and workplace safety depend on the project.

Environmental screening should occur before irreversible site commitments. Splitting one project into smaller descriptions does not lawfully avoid assessment.

Import, export and product standards

Customs registration, import controls, standards, quarantine, product-specific permission, country-of-origin, labelling and restricted-goods rules may apply. Confirm the HS classification and regulator before shipment; arrival at customs is too late to discover a missing permit.

Foreign investment overlay

Foreign ownership may be restricted or conditioned in particular sectors. Obtain foreign-investment eligibility and approval before assuming the domestic licensing path is sufficient. Cross-border technology, royalties, staff and payments may need separate approvals.

Build the regulator matrix

For each activity record: 1. exact legal and commercial description; 2. competent federal, provincial or local authority; 3. prerequisite entity, FDI, tax and industry steps; 4. premises and technical-person requirements; 5. documents, fee and submission channel; 6. inspection and pre-operation conditions; 7. product, label and advertising conditions; 8. reporting, renewal and change notification; and 9. consequence of operating without approval.

Common mistakes

- applying under the wrong product or service category; - assuming one location or product approval covers all operations; - appointing technical staff only for filing, not ongoing supervision; - importing before product permission is confirmed; - signing a long lease before site approval; - changing ownership, capacity or location without notification; and - relying on an unofficial checklist after the law changed.
