Employers need a reconciled system for worker classification, contracts, payroll, hours, leave, SSF, safety, grievances and records. Complete the statutory labour audit and close findings with accountable evidence.
Employment compliance is an operating system, not a folder of template contracts. Payroll, attendance, leave, social-security contributions, safety, disciplinary records and actual management practice must agree.
Create a complete employee register, classify each relationship, issue compliant documentation, reconcile attendance to payroll, apply current remuneration and benefit rules, enrol and contribute to applicable SSF arrangements, maintain safety and grievance systems, perform the required annual labour audit and close every finding with evidence.
For each worker record legal name, identity, address, emergency contact, employment type, start date, role, location, supervisor, remuneration, bank details, PAN, SSF status, leave, contract term and immigration permission where applicable.
Restrict access to personal data and keep retention rules. The HR list, payroll, SSF submission and labour-audit population should reconcile.
Use role-specific appointment letters or contracts. Compare labels with actual work, hours, control and duration. Correct repeated fixed-term, consultant, trainee or casual arrangements that function as regular employment.
Policies should cover conduct, attendance, leave, overtime, safety, grievance, harassment, investigation, disciplinary action, IT, confidentiality, data and remote work. Translate or explain rules so employees can understand them.
Verify the latest government minimum-remuneration notice before each payroll change cycle. Review basic remuneration, allowances, festival allowance, overtime, leave pay, deductions, tax and final settlement.
Use approved payroll changes and preserve payslips and payment evidence. Reconcile employee master data, time records, tax returns, SSF contributions and accounting ledgers.
Maintain reliable start, finish, breaks, weekly rest, shifts and overtime. Document business need and prior approval. Managers should not create off-the-clock work through messaging or remote access.
Review workloads as well as forms. Repeated excessive overtime can indicate understaffing and create safety and wage risk.
Keep opening balances, accrual, use, documents, approval and closing balances for every statutory and additional leave category. Design workflow for sickness, maternity, emergencies and substitute leave without unnecessary disclosure of sensitive information.
Assess coverage and complete employer and contributor registration through the current SSF system. Submit contributions accurately and on time and give employees access to their records. Investigate rejected or mismatched submissions.
Map SSF treatment with gratuity, provident fund, medical and accident insurance and any superior contractual benefits. Do not discontinue an existing benefit without legal and contractual review.
Maintain a hazard register, risk assessment, safety roles, training, protective equipment, emergency plan, first aid, incident report and corrective action. Requirements should match the workplace—office, factory, construction site, vehicle, laboratory and remote work have different risks.
Investigate accidents for prevention without suppressing reporting. Preserve regulator notices and insurance documents.
Publish complaint channels that bypass the direct manager where necessary. The Workplace Sexual Harassment (Prevention) Act places prevention and response duties on workplace management.
Use trained, conflict-free investigators. Preserve evidence lawfully, offer each side a fair opportunity, protect against retaliation and communicate substantiated outcomes appropriately.
Separate misconduct, capability, attendance and redundancy. Use clear allegations, evidence, employee response, proportionate action and appeal or grievance information. Apply policies consistently across seniority and identity groups.
Section 100 of the Labour Act and Rule 56 of the Labour Rules establish labour-audit requirements. The Department's Labour Audit Standard, 2075 describes the audit framework and places primary responsibility on the establishment to arrange the audit and submit the report to the prescribed body within the required period.
Audit scope covers legal and practical compliance, not only documents. Prepare employee lists, contracts, wages, time, leave, benefits, SSF, insurance, safety, policies, foreign workers, disciplinary matters and prior findings.
Management should approve a corrective-action plan with owner, due date and closure evidence. Repeating an unresolved finding increases inspection and dispute risk.
Confirm labour permission, visa, tax, contract and repatriation terms for foreign workers. For labour suppliers, verify the supplier's current licence and the establishment's own statutory responsibilities. Audit contractor conditions at the workplace rather than relying only on indemnities.
