छिटो जवाफ
Divorce in Nepal requires a District Court proceeding. The case follows either mutual consent or a statutory contested ground, then filing, service, conciliation, settlement or evidence, judgment and implementation of property, maintenance and child-related orders.
मुख्य तथ्यहरू
- ✓A private or religious divorce paper does not replace a District Court judgment.
- ✓Mutual and contested divorce require different pleadings and evidence.
- ✓Property, maintenance and child issues should be identified before filing.
- ✓The court attempts conciliation but safety must remain a priority.
- ✓The final judgment may require separate registration, transfer and enforcement steps.
Divorce process in Nepal
Divorce legally ends a marriage through the concerned District Court. A private paper, family meeting, religious declaration or separation alone does not replace the required court process.
Quick answer
First identify whether both spouses consent or one spouse relies on a statutory ground. Prepare identity, marriage, residence, family, property and child records; file in the concerned District Court; complete service, response and conciliation; settle or prove disputed issues; obtain the judgment; and then update personal-event, property, payment, custody and overseas records as applicable.
Legal framework
The National Civil Code, 2074 governs the substantive divorce rules. Section 93 permits divorce whenever both husband and wife desire it. Sections 94 and 95 provide separate grounds on which a husband or wife may petition without the other spouse consenting. Section 96 directs the spouse seeking divorce to file in the concerned District Court.
The Civil Procedure Code and court rules govern filing, jurisdiction, notice, evidence, hearings, representation and appeal. Child-related decisions must also respect the Children Act and the best interests of the child.
Step 1: confidential case assessment
Before contacting the other spouse or signing terms, identify: - whether consent is genuine and likely to continue; - the applicable statutory ground if contested; - safety, domestic violence or urgent protection concerns; - marriage and identity records; - current and previous residences; - children, present care and immediate expenses; - property, income, debt and possible coparceners; - foreign residence, citizenship or documents; and - any pending criminal, protection, custody or property case.
Immediate danger requires a safety and protection response in addition to divorce. Do not wait for the divorce case to resolve an urgent threat.
Step 2: choose the pathway
