Understand child maintenance, education and healthcare expenses in Nepal, plus custody enforcement, relocation, passports, international travel and overseas-parent issues.

Both parents must support their child according to law and financial capacity. A clear agreement or order should allocate ordinary and exceptional expenses, while relocation or international travel requires separate custody, consent, passport and enforcement review.
Both parents remain responsible for care and maintenance according to law and financial capacity even when the child primarily lives with one parent or a parent resides abroad. Cross-border facts make documentation and enforceability especially important.
Create an evidence-based child budget, disclose each parent income and capacity, allocate ordinary and extraordinary expenses, use traceable payments and keep support separate from visitation. Before relocation or international travel, review custody, consent, passport, immigration, service and foreign-recognition issues and obtain a clear order rather than relying on verbal permission.
The Children Act recognises equal parental responsibility for care, maintenance, protection, education, healthcare and development. It also provides that when parents are divorced or separated, both bear maintenance according to financial capacity.
The Civil Code contains custody and maintenance provisions dealing with the caring parent and contributions by the other parent in specified circumstances. Apply the exact text to the family facts rather than assuming a fixed percentage.
Document actual and reasonably expected costs: - food, clothing and housing contribution; - school fees, books, uniform, transport and activities; - routine healthcare, insurance, medicine and treatment; - childcare and supervision; - disability or special educational needs; - communication and contact costs; - domestic or international travel; and - agreed cultural, sports or developmental activities.
Separate recurring expenses from exceptional costs. Use invoices, school notices, prescriptions and payment records instead of unsupported estimates.
Relevant information can include salary, business income, benefits, assets, debt, necessary living costs, other dependants and reliable evidence of earning capacity. Concealing income or inflating expenses damages credibility and the child.
Financial capacity does not decide custody by itself. A parent with higher income may contribute more while the other provides substantial daily care.
State: 1. amount or allocation method; 2. payment date, account and currency; 3. costs covered by the regular amount; 4. approval and reimbursement of extraordinary expenses; 5. school and medical payment directly to providers where useful; 6. annual review or adjustment trigger; 7. documents each parent must share; and 8. lawful enforcement and variation process.
For an overseas payer, address transfer charges, exchange rate, tax or banking evidence and proof of payment. Avoid cash where records will be difficult.
A payment dispute does not automatically justify stopping parent-child contact. A visitation dispute does not automatically justify stopping maintenance. Seek enforcement, clarification or variation through the legal process while protecting the child from the conflict.
Preserve the agreement or certified order, payment schedule, bank statements, receipts and written requests. If income or child needs materially change, seek a lawful variation instead of quietly reducing or demanding a new amount.
Where a parent is abroad, service and enforcement can depend on the foreign country, the form of the Nepal order, reciprocity and local procedure. Obtain advice in both jurisdictions when necessary.
A move can affect school, daily care, travel time and contact. Give the notice required by the agreement or order and propose a revised schedule and transport allocation. Do not use relocation to defeat the other parent right or the child relationship.
Before taking a child abroad, review: - legal custody and decision-making authority; - consent from the other parent; - passport issuance and custody; - visa and destination-country requirements; - court permission or restriction; - school and medical continuity; - address, itinerary, contact and return date; and - recognition and enforceability of the Nepal order abroad.
Holiday travel and permanent relocation are different. A consent letter for one trip should not be drafted as an unlimited relocation permission.
Warning signs can include concealed passport applications, sudden asset disposal, one-way travel, removal from school, refusal to provide an itinerary or threats not to return. Seek urgent advice and proportionate court or passport-related measures. Do not respond with unlawful confinement or document destruction.
International recovery can be difficult and treaty assumptions may be wrong. Prevention and precise orders are often more effective than relying on later enforcement.
Foreign salary, school, medical, residence or court documents may require certified translation, notarisation or legalisation. Verify the Nepal court requirement before arranging authentication.
Remote consultation does not guarantee remote court participation. Service, evidence, appearance and power-of-attorney rules must be assessed for the particular case.
Do not publish passport pages, medical records, school locations, allegations or custody documents online. The Children Act protects privacy and dignity. Cross-border cases create additional data and safety exposure.
